Grounds for Disqualification: 

A person is disqualified from operating a CMV if while driving such a vehicle they either (1) commit 2 "serious traffic ticket violations" within a 3 year period or (2) commit 3 such violations within a 3 year period. See 625 ILCS 5/6-514(e)

 

Period of Mandatory Disqualification: 

  • 2 serious violations (within 3 years) - 2 months
  • 3 serious violations (within 3 years) - 4 months

Definitions:

Serious Traffic Violation:

A "serious traffic ticket violation" includes exceeding the speed limit by 15 or more MPH or reckless driving. See 625 ILCS 5/6-500

 

Examples:

    • following too closely - See 49 CFR 383.51(c)(4)
    • improper or erratic lane changes - See 49 CFR 383.51(c)(3)
    • speeding 15 mph over - See 49 CFR 383.51(c)(3)

 

The above are examples of tickets that are serious traffic violations under federal law. The Illinois Secretary has added even more traffic offenses to the list of serious traffic violations that can cancel your CDL.

 

 

CDL Operator:

A person who has obtained a commercial driver's license (CDL) and is qualified to operate a commercial motor vehicle. A commercial motor vehicle is defined as a vehicle designed to carry either passengers or property and either has a gross vehicle weight of 26,001 lbs., is designed to transport 16 or more persons, or is transporting hazardous materials which requires that the vehicle to be placarded in accordance with U.S. Department of Transportation regulations. See 625 ILCS 5/6-500

 

Will Court Supervision Protect My CDL?

The Answer: NO.

Court supervision does not effect a commercial driver's license in the same way it does a regular driver's license. Getting court supervision on a traffic ticket will NOT prevent the Illinois Secretary of State from suspending / revoking your CDL. See 625 ILCS 5/6-500
